Investigations
The Turkish Competition Board launched an investigation into the economic unity of Avixa and Avigem over allegations of abusing dominance in the double action nasal spray market by preventing competitors’ entry into the market and by failing to supply to the market one of the two nasal sprays which it distributes under the joint marketing agreement.
The Turkish Competition Board imposed a daily administrative fine totaling TRY 355.1 million on Google for breaching its 2021 obligation to treat rival local search and hotel comparison services no less favorably, as the new ‘Business Ads’ design continued to disadvantage competitors.
Settlement
The Turkish Competition Board concluded its investigation into OPET with a settlement, imposing a TRY 131.3 million fine for vertical agreements including non-compete clauses, where OPET’s lease rights were extended beyond the five-year legal limit.

Rekabet Kurulu, çift etken maddeli burun spreyleri alanında faaliyet gösteren Avixa ve Avigem’den oluşan ekonomik bütünlük hakkında, rakiplerin pazara girişini engellemek ve ortak pazarlama anlaşması kapsamında dağıtımını yaptığı iki üründen birini piyasaya vermemek suretiyle hakim durumunu kötüye kullandığı iddiaları üzerine soruşturma başlattı.
Rekabet Kurulu, Google’ın rakip yerel arama hizmetlerini ve rakip konaklama fiyatı karşılaştırma hizmetlerini genel arama sonuç sayfasında kendi ilgili hizmetlerinden dezavantajlı şekilde konumlandırmaması yönündeki 2021 tarihli yükümlülüğünü ihlal ettiğine karar vererek, yeni “İşletme Reklamları” tasarımının soruşturma konusu yerel arama tasarımlarıyla aynı nitelik ve işleve sahip olması sebebiyle 355,1 milyon TL günlük idari para cezası uyguladı.
Uzlaşma
Rekabet Kurulu, OPET hakkında yürüttüğü soruşturmayı uzlaşma ile sonuçlandırdı ve bayilik sözleşmelerinde kira hakkının beş yıllık yasal sınırı aşacak şekilde uzatılması yoluyla rekabet etmeme yükümlülüğü içeren dikey anlaşmalar yaptığı gerekçesiyle OPET’e 131,3 milyon TL idari para cezası verdi.
